These Terms and Conditions ("Agreement") set forth the general terms and conditions of your use of the "Food Safety Diary" / "FSD" mobile application ("Mobile Application" or "Service") and its related products and services (collectively, "Services"). This Agreement is legally binding between you ("User", "you", or "your") and Food Safety Diary LTD ("Operator", "we", "us", or "our").
If you are entering this Agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this Agreement. In such cases, "User," "you," or "your" shall refer to the entity. If you lack such authority or disagree with the terms of this Agreement, you must not accept this Agreement or access and use the Mobile Application or Services.
By accessing and using the Mobile Application and Services, you confirm that you have read, understood, and agree to be bound by this Agreement. You acknowledge this Agreement is a contract between you and Food Safety Diary LTD, even though it is electronic and not physically signed.
Accounts and Membership
● If you create an account, you are responsible for maintaining its security and all activities under it.
● Providing false information may result in termination.
● You must notify us immediately of any unauthorised access or breaches.
● We may suspend or delete accounts for violations of this Agreement or behaviour that damages our reputation or goodwill. Deleted accounts may not be reinstated, and we may block your email or IP address.
2. User Content
● You retain ownership of all data, information, or materials ("Content") you submit while using the Services.
● You grant us a licence to access, copy, store, distribute, and display your Content solely for providing the Services.
● We may monitor or remove Content we deem harmful, inappropriate, or in violation of our policies.
● By registering, you agree that:
● We may send you promotional emails, push notifications, and text messages.
● Your provided personal and business details may be used for marketing, advertisements, or service improvements, including collaboration with third-party companies
3. Advertising and Notifications
● The Mobile Application and website may include advertisements.
● By registering, you consent to receiving promotional material via email, text, and other means.
4. Backups
● While we regularly back up Content, we cannot guarantee accuracy or completeness.
● In case of hardware failure or data loss, we will restore backups to minimise disruptions.
5. Links to Other Resources
● The Mobile Application may contain links to third-party websites or resources.
● These links do not imply endorsement or responsibility for the content or services provided by third parties.
● Clicking on affiliate links may generate a commission for us.
6. Prohibited Uses
You are prohibited from using the Services for:
a) Illegal activities;
b) Violating regulations or third-party rights;
c) Uploading malicious code or spamming;
d) Harassing, abusing, or discriminating against others;
e) Submitting false information;
f) Interfering with security features.
We reserve the right to terminate accounts violating these terms.
7. Intellectual Property Rights
● All intellectual property rights in the Mobile Application, website, and Services remain the property of Food Safety Diary LTD.
● You may not copy, modify, distribute, or use any part of the Services without explicit written permission.
8. Changes and Amendments
● We may update this Agreement at any time.
● Changes will be communicated via notifications, email, or updates to the Mobile Application.
● Your continued use of the Services constitutes acceptance of the updated Agreement.
9. Acceptance of These Terms
By accessing and using the Mobile Application and Services, you confirm that you have read, understood, and agree to these Terms and Conditions.
